Terms of Service

1. Who we are
Swervo ("the app") is provided by [publisher's legal name, to be added], [mailing address, to be added], support@swervo.app ("we", "us"). These Terms, the End User License Agreement (EULA) and the Privacy Policy form one agreement between you and us. Beta testers are also bound by the Beta Tester Agreement. Subscribers are also bound by the Subscription Terms. All of these are bundled in the app under Settings → Legal and readable offline.
2. How you accept
You accept these Terms by reading the summary shown when the app first opens and tapping Agree and continue. The app stores the Terms version you accepted, the time in UTC and in your local time zone, and the app version, on your phone only. Two further acknowledgements have their own screens and their own stored records: the Safe-Driving Notice (shown right after these Terms, before the app asks for any permission) and the Automation Risk Warning (required before any Autopilot level above Observe can take effect).
If you tap Don't agree, the app sets Autopilot to Observe, pauses order intake, and closes, so nothing keeps acting on your behalf until you agree. The full text of these Terms, the EULA and the Privacy Policy is bundled in the app and readable offline under Settings → Legal and from the Terms screen.
When we change these Terms materially we raise the version number, record the change in the changelog, and show the summary again. Continued use after accepting the new version is agreement to it.
3. What Swervo is
Swervo is software that runs on your own Android phone. It reads the delivery offers that third-party delivery apps show on your screen, evaluates them against rules you set, speaks a verdict, and, at the levels you choose, responds to offers inside those apps on your behalf.
Swervo is not affiliated with, endorsed by, licensed by or supported by DoorDash, Uber, Grubhub, Walmart or any delivery platform. Their names and marks belong to them and appear only to identify the apps Swervo works with.
4. Autopilot levels

No level above Observe takes effect, on any install, until the current version of the Automation Risk Warning has been accepted on this phone; if the record is missing or unreadable the app behaves as Observe.
At every level the app never: enters or stores your platform login; uses a platform's API; accepts an offer whose numbers are estimates rather than what the platform displayed; accepts a Walmart Spark offer; takes a delivery photo or marks a delivery complete; contacts a customer; or puts a delivery app online except at times you scheduled yourself.
4a. Editions
The edition you download directly from us contains every level and feature described in these Terms. A Google Play edition, if published, contains Observe, Test Shift, reports and maps only and never taps; it has no Autopilot, no scheduled go-online, no drop-off automation, no self-update and no permission self-repair. The accessibility service in every edition is limited by configuration to the delivery apps and cannot read any other app.
5. Who may use it
You must be 18 or older, legally permitted to work as an independent delivery contractor where you drive, the holder of every delivery account the app interacts with, and the owner or authorised user of the phone. You may not use the app on someone else's account or device.
6. Your responsibilities
- 1. You remain the driver. Every accept, decline, pickup, delivery, photo and customer interaction is yours, whether you or the app performed the tap.
- 2. Driving. You will comply with all traffic and distracted-driving laws and will not handle the phone while the vehicle is moving. The app is built so that you do not have to: it speaks every verdict, and above 5 mph its Home screen shows one step and nothing to tap. That design does not make handling the phone safe or lawful.
- 3. Platforms. You will comply with each delivery platform's terms, or knowingly accept the consequences of not doing so as set out in the Automation Risk Warning. You will not use the app to defraud a platform, restaurant or customer.
- 4. Customer information. Offer screens and drop-off steps can show customer names, addresses, gate codes and notes. You will use that information only to complete the delivery and will not export, share or keep it beyond what the platform permits. The app helps by pruning its drop-off recordings after 30 days and letting you delete them at any time.
- 5. Taxes. Mileage, deduction and earnings figures are computed from GPS samples, what platforms displayed, and a published mileage rate. They are estimates, not tax advice, and may be incomplete. Keep your own records.
- 6. Your devices. You are responsible for the security of your phone and of any PC you choose to pair.
7. Money and figures
All earnings, hourly, profit and "worth it" figures are estimates built from what a platform displayed and what your phone recorded. They are not a statement of what you were or will be paid. We are not an employer, payment processor, lender or financial advisor, and nothing in the app is financial advice.
8. Permission self-repair (disclosure)
If you have once granted the app a special permission from a PC over a USB cable, the app can turn its own screen reader and notification access back on if Android switches them off. It does this only while a shift is active and not paused, and only while "recovery" is enabled in Settings. It never grants itself a permission you did not grant and never changes any other app's settings. You can revoke this in Settings or by removing the permission with adb.
9. Optional helper software
If you install Shizuku, the app may use it to read screens and to enable wireless debugging at boot. In release builds the app never sends taps through a Shizuku shell. Shizuku is third-party software under its own licence; installing it is your choice.
10. Automation and platform accounts
Automated tapping is available only after you accept the Automation Risk Warning. We make no promise that automation will go undetected, that any verdict is correct, or that any platform will keep your account active. Deactivation, held pay, rating effects and platform disputes are your risk, as the Risk Warning states.
11. Beta software; no warranty
The app is provided "as is" and "as available," without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Offer evaluation can be wrong. Screen reading can misread a number. GPS can miss a mile. A tap can miss or land late. The app may crash mid-shift. We do not guarantee availability, accuracy, or that it will earn you anything.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for lost earnings, deactivated or suspended accounts, held pay, missed or wrong deliveries, ratings, vehicle costs, tickets, fines, accidents, injury, or any indirect, incidental, special or consequential loss arising from the app. Our total liability for all claims in any 12-month period is limited to [the greater of $100 or the amounts you paid us in that period]. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our gross negligence or wilful misconduct.
13. Distracted driving
Nothing in the app requires or invites interaction while driving. You agree that any injury, damage, citation or loss arising from your handling of a phone while operating a vehicle is your sole responsibility, and you release us from it to the fullest extent the law allows.
14. Indemnity
You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your use of the app, your delivery accounts, your driving, your handling of customer information, or your breach of these Terms or of any platform's terms.
15. Data
The Privacy Policy explains what the app collects, where it goes, and how to delete it. In short: it stays on your phone unless you pair your own PC, tap "Send a problem report", or, in the sideload edition, choose to share shift data (see "Shift data we collect" below).
16. Changes to the app
We may add, change or remove features, including safety gates, and may require an update to keep using the app.
17. Ending this agreement
You may stop using the app and uninstall it at any time. We may suspend or end your access at any time, with notice where practical. Sections 6, 7, 10 to 14, 18 and 19 survive.
18. Disputes
Governing law: Maryland, without regard to conflict-of-law rules. Venue: state or federal courts in Frederick County, Maryland.
19. General
Entire agreement together with the EULA, Privacy Policy and any Beta or Subscription terms. Severability. No waiver by inaction. You may not assign this agreement; we may assign it to a successor. Notices to you in-app or at the email you gave us; notices to us at support@swervo.app.

Shift data we collect (sideload edition)
Sharing shift data is optional and off until you choose it: by ticking the unticked box "Share my shift data" on the Beta setup screen or in the one-time prompt on Home, or by turning on "Share shift data to improve Swervo" in Settings and tapping Turn on. The app records that choice with its version and time. While it is on, the sideload edition sends us the offers it saw during your shifts, after each shift ends, when the app opens, when you turn sharing on, and whenever a diagnostic event is recorded: the platform, restaurant, pay, our verdict and its reason, whether you accepted, the local time, the minutes and miles each offer involved, and the positions involved: your GPS position when the offer arrived and your destination, each rounded to 3 decimal places (about 110 m), the drop-off area (to about 110 m) and the restaurant (to about 1 m, because it is a business). If your destination is your home, the area of about 110 m around it is sent, not the exact point. It also sends diagnostic events: what Start, going online and setup did (each event's kind and status, the Autopilot level, which setup items were missing, and the text of the Start result message, which names apps and statuses), the app version with every upload, and the phone model and Android version with the setup event; never a position or address. Each installation has a random identifier so repeated uploads are not counted twice; it is not linked to your name, email or delivery account, and we do not join it to them. The data is received into a spreadsheet we control, is used only to improve Swervo's verdicts, is never sold or shared, and every row is deleted once it is 12 months old: the collector checks for expired rows every day (a daily check run from our computer, and on every upload or deletion request), so a row is removed within about a day of turning 12 months old. Until the collector with that check is deployed, rows are deleted on request. You can turn sharing off at any time in Settings; that stops future uploads and keeps what was already sent until you delete it or it expires. To delete everything already sent, tap "Delete my uploaded shift data" in Settings, or quote the installation identifier shown there to support@swervo.app. The Google Play edition never collects this data.
Delivery outcomes (sideload edition, a separate yes). Version 3 of the shift-data question also asks to share how each delivery went. Only if you tick the question in that version (a yes you gave to the earlier question does not cover it; the app asks you once on Home, with the box unticked, and saying no keeps sharing exactly as before) do the uploads above also carry, for each offer: what you did with it (took it, skipped it, stopped the countdown or let it expire), whether that went against our verdict, which version of our decision rules produced the verdict, and any thumbs up or thumbs down and reason you give after a shift; and, for offers you took: the minutes you waited at pickup, the minutes driving to pickup and to drop-off, the total minutes the delivery took, the actual pay and tip if the app read them from the delivery app's screen or you typed them (never an estimate), and whether and how it was cancelled. It never includes the text on your screen, and no position beyond those described above. The same identifier, retention, deletion and off switch apply.
Beta builds. Sideload builds marked as beta unlock every Autopilot level without a trial or licence ("beta pass"). The Automation Risk Warning still applies and still gates them; the beta pass is withdrawn in release builds.
